These Terms of Service ("Terms") govern your access to and use of bestgiftgallery.com (the "Site") and any purchase you make through it. The Site is operated by American Verification LLC, doing business as Best Gift Gallery ("Best Gift Gallery," "we," "us," or "our").

By accessing the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms, by our Authentication & Final Sale Policy, and by our Privacy Policy, each of which is incorporated here by reference. If you do not agree, please do not use the Site.

You must be at least 18 years old and able to form a legally binding contract to use the Site or place an order. By using the Site, you represent that you meet these requirements and that the information you provide is accurate and complete.

Best Gift Gallery offers two principal categories of items:

Authenticated autographs and signed items. Each is independently authenticated by one or more recognized third-party authentication services and is accompanied by the relevant certificate or letter of authenticity, together with a Best Gift Gallery Certificate of Authenticity. Our authenticity guarantees are described in our Authentication & Final Sale Policy.

Museum-grade reproductions. Our reproductions are based on works of art that are in the public domain. We make no claim of copyright in the underlying original artworks. Our reproductions are produced and custom-framed to order using our own materials, photography, and craftsmanship.

We describe every item as accurately as we reasonably can. Photographs are representative; because many items are antique, handmade, or custom-framed, slight variations in color, texture, framing, and finish are normal and are not defects.

All prices are shown in United States dollars unless stated otherwise and do not include shipping, import duties, or taxes, which may apply depending on your location. Prices and availability are subject to change without notice.

We make every effort to ensure that pricing and product information on the Site is accurate. In the rare event of an obvious error — for example, a price that is clearly incorrect — we reserve the right to cancel or decline any order placed at the incorrect price, even after an order confirmation has been sent, and to refund any amount charged.

Items are subject to availability. Many of our pieces are one of a kind, and an item may become unavailable between the time you view it and the time you order.

Your submission of an order is an offer to purchase. It does not constitute our acceptance. A binding contract is formed only when we send you a confirmation that your order has been accepted and is being prepared for fulfillment. We reserve the right to decline or cancel any order, in whole or in part, including where the item is unavailable, where we are unable to verify your payment or shipping details, where we suspect fraud, or where an error in pricing or description has occurred.

If we cancel an accepted order for reasons other than your breach of these Terms, our sole obligation is to refund any amount you have paid for the cancelled item.

Payment is processed by a third-party payment processor at the time of order. By submitting payment information, you represent that you are authorized to use the payment method and that the information you provide is accurate. We do not store full payment card details on our own systems. Your order will not be prepared or shipped until payment has been received in full.

Because every item is independently authenticated, made to order, or both, all sales are final and non-refundable, except as expressly set out in our Authentication & Final Sale Policy (transit damage and our Lifetime Authenticity Guarantee). Before completing a purchase, you will be asked to acknowledge that all sales are final. Please review the Authentication & Final Sale Policy carefully; its terms apply to every purchase and form part of these Terms.

We ship using tracked and insured carriers, with signature required on higher-value items. Title and risk of loss pass to you upon delivery to the address you provide, as described in our Authentication & Final Sale Policy and, where applicable, our Shipping & Payment information. You are responsible for providing an accurate shipping address and for any import duties, taxes, or customs fees on international orders.

Our authentication standard, Lifetime Authenticity Guarantee, transit-damage replacement, and the conditions that apply to each are set out in full in our Authentication & Final Sale Policy. Those guarantees are our binding commitments to you and govern in the event of any question about authenticity or condition.

Best Gift Gallery is an independent gallery and is not affiliated with, endorsed by, or sponsored by PSA, JSA, Beckett Authentication Services, or any museum or institution. References to third-party authenticators describe the independent authentication associated with an item and nothing more.

All content on the Site — including text, graphics, logos, photographs, product descriptions, page layouts, and the compilation of all of it — is owned by Best Gift Gallery or its licensors and is protected by intellectual-property and other laws. You may not copy, reproduce, republish, distribute, or create derivative works from any content on the Site without our prior written permission.

Our reproductions depict public-domain artworks; our copyright extends to our own photography, production, framing, presentation, and Site content, not to the underlying public-domain works themselves.

"Best Gift Gallery" and our logo are our marks and may not be used without our permission.

When using the Site, you agree not to:

We may suspend or terminate your access to the Site at any time if we believe you have violated these Terms.

When you contact us or submit information through the Site, you grant us the right to use that information to respond to you and operate our business, consistent with our Privacy Policy. Do not submit confidential information you do not wish us to use for those purposes. We are not obligated to keep submissions confidential except as required by our Privacy Policy or by law.

The Site may link to third-party websites, including those of authentication services. We provide these links for convenience only and do not control or endorse those sites. We are not responsible for their content, products, or practices, and your use of them is at your own risk.

Except for the express guarantees stated in our Authentication & Final Sale Policy, the Site and all products and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Nothing in this section limits the express guarantees we provide in our Authentication & Final Sale Policy or any rights you have under applicable law that cannot be waived.

To the fullest extent permitted by law, Best Gift Gallery and American Verification LLC, and our members, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Site or any product or service. To the fullest extent permitted by law, our total liability for any claim relating to a product or order will not exceed the amount you paid for the item giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

You agree to indemnify and hold harmless Best Gift Gallery and American Verification LLC, and our members, officers, employees, and agents, from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Site, you consent to those practices.

We may update these Terms from time to time. When we make changes, we will revise the "Last updated" date above. Your continued use of the Site after an update means you accept the revised Terms. We encourage you to review these Terms periodically.

These Terms, and any purchase made through Best Gift Gallery, are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or a purchase that cannot be resolved directly will be resolved through binding arbitration administered in Miami-Dade County, Florida, in accordance with the rules of a recognized arbitration body, except that either party may seek relief in small-claims court where the claim qualifies. You and Best Gift Gallery each waive any right to a jury trial and to participate in a class action, to the fullest extent permitted by law.

Before initiating any dispute, you agree to contact us at curator@bestgiftgallery.com and allow us a reasonable opportunity to resolve the matter. Nothing in this section limits any non-waivable rights you may have under applicable consumer-protection law.

These Terms, together with our Authentication & Final Sale Policy and Privacy Policy, are the entire agreement between you and Best Gift Gallery regarding your use of the Site and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
